Instant Access Terms


Terms of Use – Fluz Instant Access

These Terms of Use (“Terms”) relate to the Fluz Instant Access generated in connection with your subscription to the Fluz Fluz, LLC (“Fluz”). The Instant Access is managed by Fluz Fluz LLC and provided to you to facilitate your access to the Fluz service as an authorized user designated by Fluz.  If you have questions about these Terms or the use of the Fluz Instant Access, please contact Customer Service at +1 929-357-2780.

Section 1 – Definitions

You” and “your” mean the person or persons who have received the Fluz Instant Access and are authorized to use the Fluz Account as provided for in these Terms. “We,” “us,” and “our” mean Fluz Fluz LLC, our successors, affiliates or assignees. “Member” means a person who has registered with Fluz for an account in the Fluz App (as defined below) and who has provided all required information upon registration. The Member acknowledges it is their responsible to ensure any such information is true, accurate, current, complete and up-to-date at all times.

Section 2 – Instant Access

Your Fluz Account is secured by a linked external account (Funding Source) that you are required to establish and maintain in order to have the optional Fluz Account. You may pay down the balance on your Fluz Account using funds from a Funding Source.

Every time you make a transaction with the Fluz app, the transaction amount will be deducted from your Instant Access.  Whether you use a gift card, 1-time card or merchant tied card, all activity will be deducted from your Instant Access until that balance has been repaid.  Your Instant Access will reset each month, with a minimum of $500 per month.Your Instant Access will remain open unless you request to close your line of credit with Fluz.

The Fluz Account is designed to help you never spend more than you can pay back in full each month, based on average daily balance and transaction history in your funding source. We determine how much you have in your funding source by polling it periodically. We refer to this limit as the Instant Access.If you make a transaction that causes you to exceed the Instant Access on your Fluz Account, you agree to immediately make a payment such that you no longer exceed your available Instant Access.  Our general practice is to decline any transaction that would cause you to exceed any available Instant Access. Even if we have permitted you to exceed your Instant Access in prior circumstances, we are not required to do it in the future.

Your Instant Access is the amount that is available for you to make transactions with your Fluz Account at any given time. You will only have access to Instant Access if you have made successful on time payments for all prior transactions that have occurred during the billing cycle and you have made all required payments with regard to prior transactions. If you fail to make required payments, or any payment is returned, your Instant Access will be limited until you make that payment. The total outstanding and unpaid balance from your Fluz Account transactions will be your balance at the end of each Billing Cycle.

We may determine your Instant Access for the purpose of deciding whether to approve a Fluz App transaction at any time, including between the time you authorize the transaction and when we decide whether to allow the transaction. All transactions on your Fluz Account are subject to the applicable Instant Access.

Section 3 – Instant Access Rules

You can use the Fluz Account or contact customer service to view your transaction activity at any time. While we do our best to provide the most up-to-date information about your Fluz Account, there may be some delay in reflecting new transactions, and we cannot guarantee the accuracy of this information in the App and by phone. You are responsible for keeping track of your Fluz transactions. Our general practice is to decline transactions that will cause you to exceed your Instant Access. If we do honor these transactions, you are responsible for paying us back in full, and these limits will not increase. We may increase or decrease your Instant Access at any time, in our sole discretion.


Except as otherwise provided in this Agreement or required by Applicable Law, you are responsible for all activity conducted on your Fluz Account, and all transactions will be treated as if you had made the transaction yourself.

Section 4 – Other Transaction Limits

For security and regulatory reasons, there are limits on the number, amount, frequency, and type of transactions you can make using your Fluz Account. Similarly, there are limits on your ability to use your Fluz Account with certain merchants. To protect the security of your Fluz Account, others’ accounts and systems, we may or may not disclose some or all of these limits and any changes to these limits, unless required by law. We may change these limits from time to time at our sole discretion. We will notify you of any limits or changes to these limits if required by applicable law. In our discretion, we may permit you to make transactions in excess of these limits, but our permission to do so on one occasion does not guarantee that we will allow a transaction in excess of the limits in the future.

Section 5 – Fluz Account Interest Rates and Interest Charges


  • Annual Percentage Rate (APR) for Transactions – 0.00%
  • Balance Transfer – Not Allowed
  • Paying Interest – There is no interest charged on your account. Your entire balance must be paid in full by the due date.
  • Minimum Interest Charge – There is no interest charged on your account.
Section 6 – Your Promise to Pay

You promise to pay us all amounts due on your Fluz Account in accordance with transactions. You must pay us the entire balance amount listed on your Fluz Account, in full. If we do not receive payment reflected on your Fluz Account, you will be considered in default of the terms of this Agreement. This includes amounts where you did not sign a purchase slip or other documents for the transaction. If you let someone else use your Fluz Account, you are responsible for all transactions that person makes.

Section 7 – One-Time Transfer

You may use the Fluz App to authorize us to make a one-time transfer to us via ACH transfers from their Funding Source. You authorize us to debit or credit your selected payment method to correct any errors, process returned and reversed payments, and similar issues, to the extent permitted by law.

Section 8 – Effect of Payment on Instant Access

When we receive a payment and apply it to your open balance from a funding source, your Instant Access on your Fluz Account will increase in an amount equivalent to your payment. We may delay the change in your Instant Access until we confirm that your payment has cleared. This may happen even if we credit your payment. If you have elected to make payments from a designated Funding Source associated with your Fluz Account, your Balance will be reduced by the amount of your payment. Your Instant Access will not necessarily increase.

Section 9 – Payment Processing

We may accept and process payments without losing any of our rights. If your payment is returned unpaid for any reason, you authorize us to re-initiate the payment you authorized up to two additional times. We also reserve the right to add the returned payment amount back to your Balance.
