Fluz Gift Card Terms of Use

Your use or purchase of an Fluz Express LLC (“Fluz”) Gift Card, eGiftCard, or other stored value product (collectively, “Gift Cards”) indicates your acceptance of these terms and conditions (“Gift Card Terms”). Except as otherwise provided by law, these Gift Card Terms apply to all Gift Cards, whether purchased at store locations, online, or received from third parties. Gift Cards may only be used for redemption of Fluz services online from the Fluz platform. We reserve the right to exclude certain digital content from Gift Card redemption in our sole discretion.

• Funds on Fluz Gift Cards do not expire. Except as provided in these Gift Card Terms, no Gift Card fees apply other than a fee for Fluz’s initial issuance of the gift card, which is up to 7% of the Gift Card’s value.
• You cannot “reload” your Gift Card (i.e., add value/balance to your Gift Card).
• Gift Cards are not redeemable for cash, except to the extent required by law.
• The Gift Card may be used to make purchases only up to the available balance on the Gift Card.  The available balance of the Gift Card is reduced by the amount of each purchase of digital content and by other deductions, if any, required by law.
• If your desired purchase amount for Fluz services is greater than your available Gift Card balance, you may pay for the difference using a payment method accepted by Fluz.
• Gift Cards will not be redeemed if the card number or code is invalid or cannot be identified within Fluz systems. Allow up to four (4) hours from time of redemption for the Fluz systems to recognize and accept this Gift Card.
• Fluz is the issuer of all Gift Cards. Fluz Express LLC is organized and domiciled South Dakota, and the purchase and sale of Gift Cards issued by Fluz shall be deemed to be in South Dakota and shall be subject to the laws and regulations of South Dakota.
• In the event that the Gift Card system may become temporarily inoperative, you may be unable to obtain information about the balance on your Gift Card and Gift Card transactions, or use your Gift Card to pay for redeeming Fluz services. Please notify us if you have any problems using your Gift Card.
• We reserve the right to correct the Gift Card balance if we believe that a clerical, billing or accounting error has occurred.  You also agree that we may restrict or lock the Gift Card from use, may elect not to authorize a Gift Card transaction, or may revoke the Gift Card if we suspect fraud, unlawful activity or improper Gift Card use.  You agree that you will not use a revoked Gift Card. 
• Fluz is not responsible for any lost or stolen Gift Card or use without your permission. Protect this Gift Card like cash. If the Gift Card is lost or stolen, you may lose the remaining balance on the Gift Card, just as if you lost cash. 
• Lost, stolen, or damaged Gift Cards will not be replaced except in limited circumstances or where required by law, and only if the Gift Card has never been used and with proof of purchase.
• No more than $10,000 per day can be spent with Gift Cards as a consumer account.  No more than $250,000 per day can be spent with Gift Cards as a business account.  No more than $2,000 can be on a single gift card.
• Fluz reserves the right in its sole discretion to change or modify these Gift Card Terms at any time and in compliance with applicable law. If Fluz makes changes to these Gift Card Terms, we will provide notice as appropriate and as required by applicable law. Your continued use of Gift Cards will confirm your acceptance of the revised Gift Card Terms. We encourage you to review the Gift Card Terms from time to time to ensure you understand the terms and conditions that apply to your access to, and use of, Gift Cards.
• We may assign these Gift Card Terms at any time without notice to you. However, if we assign the Gift Card Terms, the Gift Card Terms will remain substantially the same unless you are notified.
• FLUZ MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND FLUZ’S SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD.
• IN NO EVENT SHALL FLUZ OR ITS RESPECTIVE AFFILIATES HAVE ANY LIABILITY (A) FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A GIFT CARD THROUGH ACCIDENT, MISUSE, OR FRAUDULENT MEANS OR DEVICES BY YOU OR ANY THIRD PARTY; (B) FOR ANY DAMAGES RESULTING FROM ANY CIRCUMSTANCES BEYOND THEIR CONTROL (INCLUDING ANY ACT OR OMISSION OF A MERCHANT); (C) IF THE USE OF THE GIFT CARD IS SUSPENDED OR PROHIBITED BECAUSE IT HAS BEEN REPORTED LOST OR STOLEN, OR IS BELIEVED TO BE USED SUSPICIOUSLY OR FRAUDULENTLY OR IS BELIEVED TO BE SUBJECTED TO UNAUTHORIZED USE; (D) IF YOU DO NOT HAVE SUFFICIENT FUNDS ON A GIFT CARD TO COVER A TRANSACTION; OR (E) IF A GIFT CARD CANNOT BE USED BECAUSE FLUZ’S SYSTEM IS NOT WORKING PROPERLY.
• CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

• Use and redemption of Gift Cards are also subject to the Fluz Terms of Use, available at https://fluz.app/us/legal/, which are incorporated into these Gift Card Terms by this reference.
